Learned counsel for respondent no. 1 (NDC), at the outset, raises a preliminary contention that the applicant is not in service and the present Original Application is to be filed to regularize the service of the applicant and the same is not maintainable in the eyes of law.
2. Learned counsel for the applicant, based on a preliminary contention of learned counsel for respondent no. 1, at the outset, seeks permission to withdraw the present OA with liberty to approach this Tribunal, in accordance with law, if occasion so arises.
3. In view of the above, the present OA stands dismissed as withdrawn with liberty as aforesaid.
4. There shall be no order as to costs.
