CENTRAL ADMINISTRATIVE TRIBUNAL PRINCIPAL BENCH 61/35, COPERNICUS MARG,NEW DELHI-110001 Order Sheet Item no.: 26 C.P./680/2026 (DELHI) [ CONTEMPT PETITION ] In O.A./3998/2015 TERMINATION Court No.: 2 No of Adjournment: 2 Order Dated: 04/11/2026 VIKAS BHATIA Vs SH. S. KRISHNAN SECRETARY, UNION OF INDIA

For Applicant(s) Advocate : Mr Ajesh Luthra, Ms Meenu Sharma, Mr Ali Rahim, Mr Vinay Jaiswal For Respondent(s) Advocate : Mr Hanu Bhaskar through VC, Mr Rudra Pratap Singh Order of The Tribunal The present C.P. has been filed by the applicant alleging willful defiance of directions of this Tribunal contained in Order/Judgment dated 21.05.2026 passed in the captioned O.A.

2. Notice was issued in the present C.P. on 06.08.2026 and the same was accepted by the respondents through Mr. Hanu Bhaskar, learned counsel for the respondents. The respondents sought and were accorded four weeks’ time to file compliance affidavit. Thereafter, the matter came up on 16.10.2026 and the respondents were granted further two weeks’ time to file compliance affidavit reporting full compliance of directions of the Tribunal contained in Order/Judgment dated 21.05.2026 passed in the captioned O.A.

3. It is not in dispute that the Order/Judgment dated 21.05.2026 of the Tribunal passed in the captioned O.A. has been challenged before the Hon’ble High Court of Delhi by way of Writ Petition (C) No. 11368/2026 titled Union of India & Anr. Vs. Vikas Bhatia and the Hon’ble High Court of Delhi vide order dated 09.09.2026 in Para 7 has ordered as under:- “7. In that view of the matter, we are not inclined, for the present, to stay the operation of the judgment of the Tribunal. We, however, clarify that the implementation of the said decision would be subject to the outcome of the proceeding in the Supreme Court in Civil appeal 16354/2019, directed against the judgement of the High Court of Kerala in Ajeesh A.”

4. Approximately more than two months have passed after the Order dated 09.09.2026 of the Hon’ble High Court of Delhi, however, the respondents are yet to comply with the Order/Judgment dated 21.05.2026 of this Tribunal passed in the captioned O.A.

5. Mr. Hanu Bhaskar, learned counsel for the respondents submits that SLP has been filed by the respondents before the Hon’ble Apex Court, which is likely to be listed within a week or so. On the other hand, Mr. Ajesh Luthra, learned counsel for the petitioner submits that the petitioner herein is a Caveator and to the best of his knowledge, no necessary steps have been taken by the respondents herein for getting the same listed, though, the same was filed on 29.09.2026.

6. We have considered the submissions made by learned counsels for the parties.

7. Be that as it may, mere filing of the SLP and more particularly keeping in view the order of the Hon’ble High Court passed on 09.09.2026 referred to hereinabove, the respondents ought to have complied with the directions of the Tribunal, of course, subject to outcome of the SLP. It appears that the respondents have taken the directions of this Tribunal very casually.

8. Showing indulgence, the respondents are accorded further 10 days’ time as last opportunity to file an affidavit indicating full compliance of directions of the Tribunal, which shall be subject to outcome of the SLP referred to by the respondents, failing which, the respondent no. 2, i.e., Sh. Vivek Khaneja, Executive Director, Center of Development of Advanced Computing (CDAC) Anusandhan Bhawan, C-56/1,

Institutional Area, Sector-62, Noida-201307, shall appear in person to explain non compliance on the next date of hearing.

9. List on 17.11.2026.

10. At the request of learned counsel for the respondents, Order dasti.
