CENTRAL ADMINISTRATIVE TRIBUNAL PRINCIPAL BENCH 61/35, COPERNICUS MARG,NEW DELHI-110001 Order Sheet Item no.: 49 O.A./4378/2026 (DELHI) [ APPOINTMENT ] Court No.: 3 No of Adjournment: Order Dated: 03/11/2026 BAL MUKUND PANDEY Vs DEPARTMENT OF SCHOOL EDUCATION AND LITERACY

For Applicant(s) Advocate : Mr. Faraz Anees with Mr. Divesh For Respondent(s) Advocate : Mr. S Rajappa with Mr. R Gowrishankar and Ms. G Divyashri, Mr. Dilbag Singh for DoE Order of The Tribunal The applicant had applied for the post of TGT (Sanskrit) pursuant to Advertisement Notification No. 01/2025 issued by the CBSE, inviting applications for various teaching and non-teaching posts in both KVS and NVS.

2. Learned counsel for the applicant submits that, as per the notification, the cut-off date for filling up the application form was 04.11.2025. However, vide a public notice, the cut-off date was further extended till 11.12.2025. The applicant, who belongs to the EWS category, had applied under the said category and an EWS certificate was issued to him by the competent authority on 09.12.2025.

3. He participated in the recruitment process, cleared Tier I and Tier II and was thereafter required to appear for the interview. However, at that stage, he was denied entry. He was informed that the EWS certificate produced by him had been issued beyond the cut-off date of the examination, which was only up to 04.11.2025.

4. Learned counsel for the applicant submits that, as per the respondents themselves, the cut-off date had been extended vide public notice beyond the initial cut-off date. Since the applicant's certificate dated 09.12.2025 was issued well within the extended cut-off date, i.e. 11.12.2025, the applicant was illegally and arbitrarily denied an opportunity to appear in the interview.

5. Heard.

6. Issue notice.

7. Mr. S. Rajappa, learned counsel appearing on advance service, accepts notice on behalf of Respondent Nos. 2 and 3. He refutes the submissions made by learned counsel for the applicant and submits that although the cut-off date was extended, the extension was only in respect of certain posts and not for the post in question, i.e. TGT (Sanskrit).

8. Be that as it may, since the larger issue involved in the instant OA is already pending before the Hon'ble High Court and the interview process already stands concluded, at this stage, it would be appropriate to direct the respondents to keep one post of TGT (Sanskrit) under the applicant's category vacant, subject to the outcome of the decision of the Hon'ble High Court.

9. Re-list on 21.01.2027.

10. In the meantime, parties are directed to complete their pleadings.
