1. By way of the present MA, the applicant seeks condonation of 124 days in refilling of MA No. 3844/2023 vide which condonation of delay of 78 days has been sought in filling of the accompanying OA. Learned counsel for the applicant, by referring to the assertions made in the present MA, submits that initially, MA No. 3844/2023 alongwith the accompanying OA was filed vide Diary No. 4351/2023, however, after filing, the clerk in the office of the learned counsel for the applicant had left his job and the details of filing etc. and status of the case were not informed by him. On inquiry from the applicant when the matter came to his notice, necessary steps were taken and that caused 124 days' delay in refiling.
2. Despite opportunity, respondents have not filed any reply. There is nothing on record to dispute the assertions made on behalf of the applicant.
3. In the facts and circumstances, the MA is allowed. MA No. 3844/2023 (Cod)
