CENTRAL ADMINISTRATIVE TRIBUNAL PRINCIPAL BENCH 61/35, COPERNICUS MARG,NEW DELHI-110001 Order Sheet Item no.: 51 O.A./608/2021 (DELHI) [ PAY FIXATION ] With M.A./4237/2023 FOREFEITURE OF RESPONDANTS RIGHT TO FILE REPLY Court No.: 5 No of Adjournment: 32 Order Dated: 30/10/2026 PRAVEEN KUMAR Vs M/O RAILWAYS
For Applicant(s) Advocate : Mr Yogesh Sharma For Respondent(s) Advocate : Mr Ranjan Tyagi Order of The Tribunal When the matter was taken up for hearing, learned counsel for the respondents furnished a copy of RBE No. 124/1985, wherein paragraphs 1 and 2 read as under: "1. In terms of extant provisions in the Indian Railway Establishment Manual, the General Managers may prescribe requisite promotional courses, passing of which is a prerequisite condition for promotion to a grade in a cadre. It was reiterated in this Ministry's letters Nos. E(NG)I/76/PM1/219(Pt.), dated 31.05.1977, 19.04.1977 and 02.09.1978 that wherever promotion courses have been prescribed, the passing of the same should be a prerequisite for further promotion and that no exemption should be given from passing such courses. It was also stipulated that the staff should be advised well in advance of their promotions, and of the need for them to pass the promotional courses and whenever staff are booked for any promotional training courses, they should be relieved immediately.
2.. The matter regarding promotional courses came up for a review recently. In this context, the Ministry desire to reiterate their existing instructions referred to above, for strict compliance. It is emphasized that passing of promotional courses wherever prescribed is obligatory for promotion to the concerned grade and no laxity should be allowed in this regard." However, as noticed in the order dated 24.07.2026, the respondents were also required to clarify whether the concerned General Manager had prescribed any such promotional course in respect of the present applicants. Further, a specific query had been raised regarding the dates on which the candidates up to Serial No. 173 and the present applicants had undergone and successfully completed the CP-7 Course, particularly in view of the applicants' contention that both sets of candidates had undergone the said course simultaneously. The aforesaid queries have not been satisfactorily answered by the respondents. The mere production of RBE No. 124/1985 does not clarify whether any specific promotional course was prescribed by the concerned General Manager for the applicants or how the applicants were treated differently from the candidates up to Serial No. 173 in the matter of pay fixation. In view of the above, the respondents are once again directed to furnish the aforesaid clarifications by way of a detailed affidavit, duly supported by the relevant documents and instructions, before the next date of hearing. List on 30.11.2026.
