1. Learned counsel for the Applicant submitted that the Applicant was granted financial upgradation under the MACP Scheme with effect from 01.01.2016 in the Grade Pay of Rs. 4,800/-. Subsequently, she was promoted to the post of Income Tax Officer (ITO) on a regular basis with effect from 24.05.2022. However, even after her promotion, she continued to draw the same Grade Pay of Rs. 4,800/-.

2. Learned counsel fairly submitted that the Applicant had remained on Extraordinary Leave (EOL) during the relevant period and that the said period had been excluded while calculating her qualifying service. After excluding the period of EOL, the Applicant completed four years of qualifying service in the Grade Pay of Rs. 4,800/- on 15.03.2023. Accordingly, she submitted a representation dated 20.11.2024 seeking grant of the next Grade Pay of Rs. 5,400/- with effect from 15.03.2023.

3. It was further submitted that the Applicant continued to draw Grade Pay of Rs. 4,800/- for more than four years, including after her regular promotion as ITO, and was, therefore, entitled to the next Grade Pay of Rs. 5,400/- in terms of the applicable Government of India instructions.

4. Learned counsel for the Applicant further submitted that the present O.A. has been filed challenging the order dated 23.06.2026, whereby the Respondents rejected her claim for grant of Grade Pay of Rs. 5,400/- on the ground that the service rendered pursuant to financial upgradation under the MACP Scheme could not be treated as regular service for the purpose of grant of NFU.

5. Issue notice. Mr Archit Vasudeva, learned counsel, who appears on advance service, accepts notice for the respondents. He seeks and is granted four weeks' time to file counter affidavit. Two weeks' time thereafter is granted to the Applicant to file rejoinder, if any.

6. List before the Principal Registrar for completion of pleadings on 19.01.2027. Shri Rajveer Singh Verma Member (J) Chhabilendra Roul Member (A) Pinky Yadav ( steno 'c' )
