ORAL ORDER

(As per Hon’ble Mr. Manish Garg, Judicial Member)

The instant O.A. is filed by the applicant, seeking the following relief: “....to declare the inaction of the respondents in not considering the candidature of the applicant for grant of temporary status followed by regularisation to the applicant in the regular post though he is eligible and entitled as per the instructions/ orders issued time and again as illegal, arbitrary, discriminatory and unconstitutional and consequently direct the respondents to regularise the services of the applicant on par with their juniors with all consequential benefits and pass any other order as is deemed fit, proper in the circumstances of the case.”

2. Highlighting the facts of the case, learned counsel for the applicant submitted that the Applicant was initially appointed on casual basis as a Beldar with effect from 01.06.1988 and his services have been utilised as a Beldar continuously, without any remark, till date, having completed more than 38 years in the department. Though most of his juniors were granted Temporary Status and regularised earlier, his name was not even included in the seniority list for a long time, despite several requests made by him. It is stated that there are 18 vacancies available now and steps are being initiated to fill them. It is the grievance of the Applicant that the Respondents have not regularised his services even though vacancies are available and he is eligible and entitled, and that his juniors have been regularised ignoring his claim. Aggrieved by the same, the present O.A. is filed seeking a declaration that the inaction of the Respondents in not regularising his services is illegal. 5. In these circumstances, the limited relief that can be granted in the present O.A. is to give the Applicant an opportunity to make a fresh representation, and to direct the Respondents to dispose of the same. The Applicant may make a detailed representation within seven (7) working days, enclosing the various orders passed by this Tribunal and the Hon’ble High Court that are placed on record, and citing the case laws relied upon in the grounds and in the earlier round of litigation. Upon receipt of such representation, the Respondents shall dispose of it within thirty (30) days, following the principles of natural justice and in the light of the dicta laid down in the aforesaid decisions, taking note of the length of service rendered by the Applicant, the orders passed earlier by this Tribunal and the availability of vacancies, and shall communicate the decision to the Applicant, in accordance with law.
