ORDER (ORAL)

The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985 praying for the following relief: Digitally signed by Sonali Lal Sonali Lal

“(a) Quashing of the impugned (advertisement notice for recruitment of non-faculty Group ‘A’ posts at AIIMS Deoghar on Direct Recruitment Basis) for filling up 4 (four) posts of Assistant Nursing Superintendent in AIIMS, Deoghar, dated 22/9/25.

(b) For a direction of mandamus be issued to the respondents to adhere to the decision of Central Institute Body as taken in its various meeting from time to time particularly decision taken in 2nd meeting dated 10/12/2018, qua adoption of recruitment rules of all posts of AIIMS, New Delhi for the corresponding posts in all new AIIMS with prospective effect and decision in meeting dated 16/6/2021 to follow DoPT guidelines/ DOPT OM dated 20/9/2022.

(c) Call the entire records of the advertisement along with file noting with regard to issuance of the advertisement dated 22/9/25 for ANS.

(d) For a direction upon the respondent to initiate promotion procedure for filling the vacancy as per rules AIIMS New Delhi for the post of ANS.

(e) Any other directions as your lordship may deem fit and proper in the facts and circumstances of this case in the interest of justice.”

2. Heard learned counsel for the parties at length.

3. The present matter is fixed for filing of reply to MA Nos. 251/2026 and 509/2026. However, the same has not yet been filed.

Learned counsel for the respondents submits that no reply to the aforesaid MAs is required to be filed, as the order impugned in the instant OA has already been withdrawn by the competent authority, thereby rendering the present proceedings infructuous. In support of her submission, she has also produced a copy of the relevant communication clarifying that the notification in question has since been withdrawn.

5. On the other hand, learned counsel for the applicant insists that a reply to the aforesaid MAs is still required. However, upon consideration of the submissions made by learned counsel for the parties and the document placed on record by the respondents, this Tribunal is of the Digitally signed by Sonali Lal Sonali Lal view that filing of such reply would serve no useful purpose, particularly in view of the subsequent withdrawal of the impugned notification.

6. In view of the above, this Tribunal is satisfied that the cause of action giving rise to the instant OA no longer survives and the matter has, accordingly, been rendered infructuous.

7. Accordingly, the OA is dismissed as having become infructuous. All pending MA(s) also stand disposed of accordingly.
