CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 3 O.A./576/2026 (RANCHI) [ SENIORITY ] Court No.: 1 No of Adjournment: 1 Order Dated: 04/11/2026 SUPARNA BANERJEE Vs HEALTH AND FAMILY WELFARE

For Applicant(s) Advocate : Mr. Mohan Kumar Dubey For Respondent(s) Advocate : Mr. Ranesh Anand, Sr. Panel Counsel, Mr. M. P. Dixit Order of The Tribunal Learned Counsel for the parties are present and heard. MA No. 466/2026 has been filed seeking condonation of delay of 82 days in filing the instant Original Application. The matter was fixed for filing of reply to the said MA; however, no reply has been filed on behalf of the respondents. Considering the relatively short period of delay and the fact that no objection has been raised by the respondents, MA No. 466/2026 is allowed and the delay of 82 days in filing the Original Application is condoned. Issuance of formal service of notice is waived off since learned Counsel Mr. Ranesh Anand appears on behalf of Official Respondent Nos. 1 to 4 and learned Counsel Mr. M. P. Dixit appears on behalf of Private Respondent Nos. 5 to 21, on receipt of advance copies of the OA and MA.

MA No. 465/2026 has been filed by the applicants seeking permission to jointly pursue the instant Original Application. Upon consideration, this Tribunal is satisfied that the applicants share a common grievance and are pursuing a common cause of action. Accordingly, the prayer is allowed under Rule 4(5)(a) of the CAT (Procedure) Rules, 1987. MA No. 465/2026 is accordingly disposed of. Learned Counsel Mr. Ranesh Anand, appearing for Official Respondent Nos. 1 to 4, and learned Counsel Mr. M. P. Dixit, appearing for Private Respondent Nos. 5 to 21, have raised a preliminary objection regarding the maintainability of the present OA before this Tribunal. Their objection is founded on the ground that the present proceedings would amount to duplication of proceedings, as the applicants have already instituted Reference Case No. 05/2026 before the Industrial Tribunal, Dhanbad. Both learned Counsel for the respondents, having already received advance copies of the OA, are directed to file their respective written statements on or before the next date of listing. List the matter for further consideration on 20.01.2027.
