CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 5 O.A./717/2026 (RANCHI) [ CONSEQUENTIAL BENEFITS ] Court No.: 1 No of Adjournment: Order Dated: 04/11/2026 SMT NASIMA PARWEEN Vs CIP

For Applicant(s) Advocate : Mr. Anis Khan through VC mode For Respondent(s) Advocate : Mr. Amit Sinha, ASC Order of The Tribunal Learned Counsel for the parties are present and heard. Learned Counsel for the applicant prays for issuance of notice. Issuance of formal service of notice is waived off since learned Counsel Mr. Amit Sinha appears on behalf of the respondents on receipt of advance copy of the OA. Upon perusal of the record, it is observed that the applicant had earlier filed OA No. 60/2017, which was decided in her favour. The said order of this Tribunal was assailed by the department before the Hon'ble High Court of Jharkhand at Ranchi in WP(S) No. 2172/2019. However, the writ petition was subsequently dismissed for default.

It is further noted that the applicant has since been taken back into service. However, the issue that survives for consideration in the present OA relates to the treatment of the intervening period from 08.08.2016 to 31.05.2023. The applicant seeks a declaration that the said period be treated as spent on duty for all purposes, along with consequential benefits. Learned Counsel for the respondents seeks time to obtain necessary instructions and file a detailed written statement. In view of the request made, learned Counsel for the respondents is directed to file the written statement positively within a period of four weeks. List the matter for filing of written statement on 18.01.2027.
