CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 7 O.A./722/2026 (RANCHI) [ COMPASSIONATE APPOINTMENT ] Court No.: 1 No of Adjournment: Order Dated: 04/11/2026 SATISH KUMAR PATHAK Vs DEPARTMENT OF POSTS

For Applicant(s) Advocate : Mr. Rishabh Kaushal For Respondent(s) Advocate : Mr. Rajendra Krishna, CGSC Order of The Tribunal Learned Counsel for the parties are present and heard. Learned Counsel for the applicant prays for issuance of notice. Issuance of formal service of notice is wavied off since learned CGSC Mr. Rajendra Krishna appears on behalf of the respondents on receipt of an advance copy of the OA. Learned Counsel for the applicant submits that he had earlier filed an OA No. 308/2025 seeking the same relief, which was disposed of by this Tribunal vide order dated 25.04.2025, with a direction to the respondent authorities to consider and decide his representation. It is further submitted that, upon consideration, the representation was rejected. The applicant has assailed the rejection, inter alia, on the ground of hostile discrimination, contending that a similarly situated individual, namely Miss Puja Kumari, had been granted the benefit of compassionate appointment. Learned Counsel points out that the reasoned order rejecting the applicant's claim refers to specific instructions issued by the Directorate vide communication dated 09.02.2022, whereas, in the applicant's case, the rejection appears to be based on non-fulfilment of the prescribed eligibility criteria, particularly the age criterion. At this stage, it is not clear whether Miss Puja Kumari was similarly placed with regard to the age-related eligibility criteria or whether her case involved any distinguishing circumstances. The said aspect, therefore, requires clarification from the respondents. Learned Counsel for the respondents is directed to file the written statement within a period of four weeks. List the matter for filing of written statement on 19.01.2027. KUMAR RAJESH CHANDRA Member (A) Sonali Lal ( court master )
