CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 18 O.A./331/2026 (RANCHI) [ COMPASSIONATE APPOINTMENT ] Court No.: 1 No of Adjournment: 3 Order Dated: 04/11/2026 AKANSHA KUMARI Vs BSNL

For Applicant(s) Advocate : Mr. Vikash Kumar, v/c mode For Respondent(s) Advocate : Mr. Prabhat Kumar Sinha Order of The Tribunal Learned Counsel for the parties are present and heard. MA No. 357/2026 has been filed seeking condonation of delay in filing the present OA. Upon perusal of the record, it is observed that the issue relating to the applicant's claim for appointment on compassionate grounds had earlier arisen in OA No. 895/2022. The said OA was subsequently withdrawn by the applicant. It transpires that, at the relevant time, the applicant's mother, being the widow of the deceased employee, had also submitted an application for appointment on compassionate grounds, thereby asserting her claim in preference to that of the applicant. In view of this circumstance, the applicant had sought withdrawal of her candidature, and this Tribunal had permitted withdrawal of the OA, observing that the applicant's mother could pursue the claim in her own right and, if so advised, seek consideration of her daughter's candidature. Learned Counsel for the respondents, upon instructions, submits that the applicant's claim for appointment on compassionate grounds is presently under consideration before the departmental authorities and that an appropriate decision shall be taken in accordance with law. In view of the aforesaid submission and the fact that the respondents have already taken up the applicant's claim for consideration, MA No. 357/2026 seeking condonation of delay is allowed. In the meanwhile, it is noted that the respondents have already filed their written statement in the present OA. However, the same has not yet been formally taken on record and is presently lying with the Registry. Learned Counsel for the applicant has already received a copy of the written statement and seeks time to peruse the same and file a rejoinder, if so advised. Accordingly, the written statement is directed to be taken on record. The prayer made on behalf of the applicant is allowed, and learned Counsel for the applicant is directed to file a rejoinder, if so desired, positively on or before the next date of listing. List the matter for filing of rejoinder on 20.01.2027.
