01. Heard on MA/1509/2026. The applicants, 137 in number, have jointly filed the instant OA, pleading similar facts, a common cause of action and identical reliefs. In view of the submissions made in support of the application, the same is allowed. The applicants are permitted to maintain the present original application jointly to avoid multiplicity of litigation and conflicting orders.

02. Through the medium of the present petition the applicants seek for the following reliefs- gmail.com

a. Issue an appropriate, order or direction, commanding the respondents to grant confirmation to the applicants against the posts of Headmasters with effect from the respective dates falling between June 2021 and June 2022, with notional benefits for the period from the date of entitlement till June 2022 and monetary benefits with effect from June 2022 onwards, on the same analogy and on the pattern adopted in the case of Masters promoted as Headmasters in the Jammu Division, who were junior to the applicants, thereby ensuring parity, fairness and non- discriminatory treatment in the matter of service benefits;

b. Issue an appropriate order or direction, commanding the respondents to consider the applicants for promotion to the next higher posts of Zonal Education Officers, strictly in accordance with their inter se seniority and eligibility, by taking into consideration their rightful position in the seniority of Masters and their entitlement to confirmation against the posts of Headmasters, and to extend the consequential benefits of promotion to the eligible applicants in accordance with the applicable rules, without any further delay;

c. Issue an appropriate, order or direction, commanding the respondents to finalise the cases of confirmation of the applicants against the posts of Headmasters forthwith and to pass a reasoned and speaking order explaining the inordinate and unexplained delay in finalising their confirmation, particularly when candidates from the Jammu Division, who were junior to the gmail.com

applicants had been promoted as Headmasters on an in-charge basis, have already been confirmed, whereas the claims of the applicants and other similarly situated candidates from the Kashmir Division have remained pending without any justifiable reason;

d. Issue an appropriate order or direction, commanding the respondents to consider and extend to the applicants the same treatment and service benefits as have been extended to similarly situated candidates of the Jammu Division in terms of Government Order No. 205-JK (EDU) of 2023 dated 8 July 2023, and to grant them the consequential benefits flowing therefrom;

e. Pending final disposal of the instant petition, direct the respondents to consider the claim of the applicants for confirmation against the posts of Headmasters on the same analogy and in accordance with the same criteria as adopted in favour of the candidates of the Jammu Division under the aforesaid Government Order, and to take an appropriate decision within such time as this Hon’ble Court may deem fit and proper.

f. Pass any other order or direction which this Hon'ble Court may deem just, proper and appropriate in the facts and circumstances of the case, in favour of the applicants and against the respondents, in the interests of justice.

03. The case of the applicants, as projected in the O.A., is that they are aggrieved of the failure of the respondents to consider and accord confirmation against the posts of Headmasters, despite they having held gmail.com

the said posts on an In-charge / Look-after basis for considerable periods, including more than two years. They contend that, notwithstanding their eligibility and seniority, persons junior to them, particularly those belonging to the Jammu Division, have been granted confirmation and consequential promotional benefits, whereas their own claims have remained unattended without any justifiable reason.

The applicants further submit that their names figure in the final UT-level seniority list of Masters and that they occupy positions higher than several employees who have already been granted confirmation as Headmasters and, in some cases, further promoted as Zonal Education Officers. Despite their seniority and continued discharge of duties as Headmasters, their claims have not been considered. They contend that such differential treatment, particularly when employees stated to be junior to them have been extended corresponding service benefits, is arbitrary and discriminatory and offends the principles of fairness and equality in public employment.

Learned counsel for the applicants submits that, despite their eligibility and seniority, several junior Masters were placed as In-charge Headmasters in 2022 and subsequently confirmed vide Government Order No. 205-JK-EDU of 2023 dated 08.07.2023. In contrast, some of the applicants were placed as In-charge Headmasters only vide Government Orders dated 05.01.2024 and 10.04.2025; however, their claims for gmail.com

confirmation/regularisation against the said posts have not been considered, despite their having discharged the duties of Headmasters for considerable periods. In this regard, learned counsel refers to the relevant placement orders and Government Order No. 193-JK-EDU of 2026 dated 19.05.2026, and submits that the respondents have extended corresponding benefits to similarly situated employees belonging to the Jammu Division.

Learned counsel further submits that certain employees belonging to the Jammu Division, whose dates of appointment as Teachers range from 1990 to 1994 and who were subsequently promoted as Masters during 2007–2011, were placed as In-charge Headmasters in June 2022 and thereafter granted confirmation against the said posts. Certain such employees were also extended notional benefits with effect from 2021 and monetary benefits with effect from 2022. It is further contended that employees whose dates of promotion as Masters are comparable to or later than those of the applicants have also been considered for confirmation as Headmasters and, in some cases, promoted even as Zonal Education Officers. In this regard, reliance is placed upon Government Order No. 193-D-JK Edu of 2026, whereby certain employees of the Jammu Division were placed as Headmasters and equivalent In-charge Zonal Education Officers.

07. On the other hand, learned counsel draws attention to the service particulars of employees belonging to the Kashmir Division, submitting that certain employees appointed as Teachers during 1990–1993 and promoted as Masters in June 2007 and March 2008 were subsequently placed as In-charge/Look-after Headmasters in January 2024 and April 2025, respectively, but their claims for confirmation and consequential benefits remain undecided. He contends that the difference in the dates of placement and the subsequent grant of confirmation benefits to employees of the Jammu Division, while leaving the claims of similarly situated employees of the Kashmir Division unattended, demonstrates the differential treatment complained of by the applicants.

Learned counsel for the applicants further submits that the posts of Headmasters and Zonal Education Officers are State Cadre posts and, therefore, the respondents are required to apply the governing service rules and prescribed procedure uniformly throughout the Union Territory of Jammu and Kashmir. The applicants claim to possess the requisite eligibility and length of service and to have discharged the duties of Headmasters on an In-charge / Look-after basis. Their service records, APRs, integrity certificates and other prescribed eligibility conditions are, therefore, required to be considered in accordance with the applicable rules and procedure, without discrimination or undue delay. employee; their grievance is that the same standards and principles have not been applied while considering their own claims.

09. In this regard, learned counsel submits that SRO 308 of 2008 prescribes the procedure for promotion to the posts of Headmasters and Zonal Education Officers. According to the applicants, despite fulfilling the requisite eligibility conditions, their cases have not been placed before the competent authority / DPC for consideration in accordance with the prescribed procedure. He further submits that their claims are required to be examined by taking into consideration the final seniority lists, dates of promotion as Masters, dates of In-charge placement as Headmasters, availability of sanctioned vacancies, prescribed eligibility conditions and relevant DPC/consideration proceedings, so as to ensure a fair and objective determination of their claims.

Learned counsel further submits that, vide communication dated 03.02.2022, the Administrative Department had directed the Directors, School Education, Kashmir/Jammu, to verify the service particulars, present place of posting and service status of Masters proposed for placement as In-charge Headmasters on a Look-after basis. The said exercise was undertaken with reference to the relevant seniority and eligibility particulars, and the applicants claim to have furnished the requisite records in compliance with the said communication. whereas certain employees belonging to the Jammu Division were subsequently placed as In-charge Headmasters. In this regard, reliance is placed upon the communication dated 03.02.2022, annexed as Annexure A-7.

Learned counsel also refers to Government Order No. 1746-EDU of 2022 dated 27.06.2022, whereby placements as In-charge Headmasters were ordered, and submits that the said order is material to the controversy, particularly in view of the applicants' assertion that more than 400 posts of Headmasters in the Kashmir Division were vacant at the relevant time. The applicants contend that the placement exercise appears to have departed from the seniority-based process initiated by the Administrative Department, notwithstanding their having furnished the requisite service particulars. They further submit that the joint seniority list, communication dated 03.02.2022, subsequent placement orders and orders granting confirmation to employees of the Jammu Division, when considered together, raise serious questions regarding the uniformity and fairness of the procedure adopted by the respondents.

Learned counsel accordingly submits that the respondents are required to examine the relevant joint seniority lists, proposals, DPC/consideration proceedings, eligibility records, vacancy position and confirmation orders pertaining to both divisions, and explain the non-consideration of the applicants despite their claimed seniority, eligibility and compliance with gmail.com

the prescribed requirements. He further contends that, as per the past practice, promotions to the posts of Zonal Education Officers were made strictly in accordance with the seniority of Masters and, therefore, the respondents cannot adopt different standards while extending confirmation and consequential promotional benefits to similarly situated employees.

Learned counsel further submits that the continued failure of the respondents to consider the applicants' claims has caused serious prejudice, particularly to those applicants who have already attained the age of superannuation. Such inaction has adversely affected their service progression, pay fixation and consequential retiral benefits, to the extent permissible under the applicable rules. He contends that the applicants cannot be made to suffer on account of unexplained administrative inaction, particularly when similarly situated employees have already been granted confirmation and further promotion. The applicants, therefore, seek consideration of their claims for confirmation from the dates legally admissible, together with consequential service and retiral benefits under the applicable rules. Learned counsel further submits that the applicants have repeatedly approached the competent authorities through representations seeking consideration of their claims for confirmation as Headmasters and grant of consequential benefits, as well as rectification of the alleged irregularities in the placement and confirmation exercise. However, no effective decision has been taken by the respondents. He gmail.com

contends that such inaction, despite the availability of the relevant service records and the applicants' asserted eligibility and seniority, is arbitrary and discriminatory. In support of their contentions, learned counsel also places reliance upon the judgment of the Hon'ble Supreme Court in Suraj Prakash v. State of Jammu and Kashmir, and submits that the applicants' claims deserve consideration in the light of the applicable statutory rules and judicial precedents governing In-charge / Look-after arrangements and regular promotion. The exact citation and ratio of the said judgment are stated to be subject to verification.

14. Having exhausted the available administrative remedies, the applicants claim to have been left with no efficacious alternative but to invoke the jurisdiction of this Hon'ble Tribunal. They accordingly seek appropriate directions to the respondents for a uniform, transparent and non- discriminatory consideration of their claims for confirmation against the posts of Headmasters from the dates legally admissible, after taking into account their seniority, eligibility, service particulars and the prescribed DPC procedure, and for grant of consequential promotional and retiral benefits, wherever admissible under the applicable service rules and law. They further seek that the respondents be directed to pass appropriate reasoned and speaking orders on their claims in accordance with law.

15. Learned counsel for the applicants argued the matter at length and then submitted that the applicants would be satisfied if this Tribunal directs the gmail.com

respondents to treat the present O.A. as a representation and the respondents are directed to consider and decide the same within a stipulated time frame, in light of the averments made therein, along with the documents annexed and the law applicable in the instant case.

Learned counsel for the respondents, Mr. Satinder Singh, AAG, submits that, without prejudice to their rights and contentions, the respondents have no objection if the present O.A. is treated as a representation and is disposed of in terms of the submissions advanced on behalf of the petitioner.

18. Learned counsel for the parties are ad idem that the present O.A. may be disposed of at this stage by treating the same as a representation.

Accordingly, without expressing any opinion on the merits of the case, the present O.A. is disposed of with a direction to the respondents to treat the instant OA, along with all the annexures, as a representation of the applicants and consider their claims on the same analogy as in the case of Masters regularised / confirmed as Headmasters in the Jammu Division. This consideration will be accorded in the light of the applicable rules, regulations, law holding the field and, if there are no other impediments and pass a reasoned and speaking order, subject to the applicants’ entitlement and eligibility.

20. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order, by passing a comprehensive reasoned and speaking order.

21. It is clarified that this Tribunal has not expressed any opinion on the merits of the claims or contentions raised by either side. All questions of fact and law are left open to be considered by the competent authority, in accordance with law.

22. Accordingly, O.A. No. 1242/2026 is disposed of along with the connected M.As., if any. Parties are to bear their own costs.
