Per: Hon’ble Shri Jayesh V Bhairavia, Member (J)

1. In the instant OA, the applicant being aggrieved with the order dated 30.10.2026, issued by the CTCC ADI i.e., respondent no.2 herein by referring Telephonic Messsage received from Divisional Electrical Engineer (TRO) i.e., respondent no. 3 herein informed the CTCC GIM, Gandhidham that the applicant who is working as Loco Pilot, Male, LPM working under CTCC/ADI is being sent to CTCC GIM for working at MDPT (Mundra Port) on loan basis, has filed the present OA under Section 19 of the Administrative Tribunal Act, 1985, seeking relief to quash and set aside the impugned transfer order dated 30.10.2026.

2. On receipt of the impugned order dated 30.10.2026 (Annexure A/1), the applicant submitted his representation dated 04.11.2026 (Annexure A/5) before the respondent no.3 and requested to cancel his transfer order to MDPT by stating various reasons in the said representation.

3. It is stated that the respondents vide order dated 02.11.2026 (Annexure A/4) treated the applicant as relieved. Since, the applicant is suffering from serious illness, he is undergoing medical treatment at Ahmedabad and therefore, he could not join at the transfer place of posting i.e., at MDPT, Gandhidham.

He is also suffering from various health issues for which he is undergoing continuous medical treatment at Ahmedabad. Therefore, the respondents should reconsider the pending request/application of the applicant.
