Santhosh V.S., Assistant Director (Staff), Office of the CPMG, Kerala Circle, Thiruvananthapuram - 695 033. - Respondents [By Advocate : Mr. M.N Manmadan, SCGSC ] The Original Application having been heard on 04.11.2026, the Tribunal on the same day delivered the following: O R D E R (Oral):- Justice K.Haripal, Judicial Member The Original Application is essentially challenging the transfer of the applicant as Postal Assistant (Circle Office) from Thiruvananthapuram to Kozhikode. The applicant has submitted that he has immunity from a routine transfer. By order of the Tribunal dated 29.05.2025, operation of the order has been stayed and the applicant is continuing in Thiruvananthapuram.

2. Respondents have opposed the claim of the applicant and prayed for dismissing the O.A. His subsequent representations were also rejected.

3. Today when taken up for consideration, applicant has filed M.A/1028/2026 along with additional documents, Annexures A 30 to A 33.

4. Annexure-A30 shows that a new Headquarters Regional Office

A X Sherin was started in Thiruvananthapuram and willingness of Postal Assistants was called for. The applicant applied to the post and by Annexure-A 32, he stands transferred and posted as Postal Assistant in the new Regional Office. However, they have raised a technical contention through Annexure- A 33 that, since there is an interim order in force, he cannot be transferred.

5. We make it clear that in the light of Annexure-A 32 order, Annexure-A1 has lost its relevance. Annexure-A 33 can be ignored. Thus, it is very clear that there is no impediment in appointing the applicant on transfer in the newly created post in the Regional Office. The Miscellaneous Application No. 1029 of 2026 is allowed.

6. We also make it clear that we have not gone into the merits of the contentions raised by both parties.
