1. This hearing has been done through hybrid mode. CM APPL. 70152/2026 (for exemption)

2. Allowed, subject to all just exceptions. Application is disposed of. W.P.(C) 14967/2026 & CM APPL. 70151/2026

3. The present petition has been filed by the Petitioner under Article 226 of the Constitution of India seeking a direction to the Respondents to issue a Certificate of Vending to the Petitioner after considering the documents submitted by him under Vending ID V2025100054.

4. The case of the Petitioner is that he is a street vendor and suffers from 50% disability in all of his four limbs and trunk as per the disability certificate of the Petitioner placed on record.

5. He had commenced vending at PT-28, Bank of Baroda, Janpath Market, Connaught Place, New Delhi as per the Petitioner and has been

continuously vending since 2000.

6. Petitioner is stated to be part of 628 list of vendors submitted by the New Delhi Municipal Council (hereinafter ‘NDMC’) in the year 2012 before the Supreme Court and his name appears at serial no.226.

7. In January, 2025, he was surveyed by the NDMC and vending ID V2025100016 was issued to the Petitioner on 1st February, 2025. However, no provisional CoV was issued.

8. Thereafter, a second vending ID V2025100054 was generated for the Petitioner on 1st March, 2025 by the NDMC.

9. The Petitioner found that his name was not included in the first eligibility list under the Vending ID V2025100054. The ground raised for non- inclusion was that there was no residence in Delhi shown by him.

10. According to the Petitioner, he had submitted the affidavit and identity documents under the said ID. However, even in the subsequent eligibility list, his name did not appear.

11. He then submitted further representations, but no provisional CoV has been issued.

12. Apprehension of the Petitioner is that though the Petitioner has uploaded the required documents, his name may not be included even in the survey which is presently being carried out by the NDMC. Hence, there is an urgency.

13. Ms. Shobha Gupta, ld. Counsel appearing for the NDMC accepts notice. She submits that the NDMC would examine the documents of the Petitioner.

14. Heard. A perusal of the record would show that the Petitioner is suffering from Becker’s Muscular Dystrophy of more than 50%. In such

cases, the Authority ought to take an empathetic view.

15. The Petitioner has been issued challans for several years. It is possible that due to generation of two vending IDs, the documents have not been properly considered by the NDMC/TVC.

16. In view of this position, it is directed that the Petitioner’s case be considered by the Joint Director, TVC. The documents of the Petitioner be presented by the Petitioner to the said Joint Director, TVC on 17th November, 2026 at 2:30 PM.

17. After verifying all the documents of the Petitioner, the said Joint Director shall include the Petitioner’s name in the eligible list of vendors and shall also take steps towards issuance of a provisional CoV with any one vending ID. The second vending ID shall be cancelled so that no confusion is created in future.

18. After the TVC-II is constituted, the Petitioner’s case shall be considered for issuance of final CoV as a stationary vendor, owing to his disability, within three months after constitution, in terms of Section 21 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

19. The petition is disposed of in the above terms. Pending applications, if any, also stand disposed of. PRATHIBA M. SINGH JUDGE DINESH BHATT JUDGE NOVEMBER 3, 2026/dk/as
