IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI
IA 1101/2026 (Waiver) in A.IR:1175/2026
H Ekanthaiah V/S Canara Bank
04/11/2026
Learned Counsel for both sides are present.
This appeal is filed against the final order dated 10.2.2026 passed by the Learned Presiding Officer, DRT-I, Karnataka at Bengaluru in OA No.203 of 2020.
OA No.203 of 2020 has been filed by the Respondent Bank for recovery of a sum of Rs.1,85,85,938/- with future interest and costs. The Learned Presiding Officer, DRT-I, Karnataka at Bengaluru allowed the Original Application and directed recovery of Rs.1,85,85,938/-, together with simple pendente lite and future interest at the rate of 6% per annum, from the date of application till the date of realization of the entire claim amount in full along with costs due and outstanding to the Respondent Bank.
It is the submission of the Learned Counsel for Petitioner that Petitioner availed KCCS Credit Facility for Rs.3.00 lakhs on 8.1.2010 and this Facility was enhanced from Rs.3.00 lakhs to Rs.5,50,000/-. However, the Respondent Bank, in its counter, added both these amounts i.e., Rs.3.00 lakhs and Rs.5,50,000/- to arrive at the loan availed at Rs.1,61,50,000/-, which is wrong. Petitioner has already made a pre-deposit of Rs.46,50,000/- and this payment would meet the requirements of pre-deposit for entertaining the appeal. Thus, he seeks for allowing the waiver application.
Learned Counsel for Respondent Bank submitted that the outstanding due, as on the date of filing the appeal, after calculating the interest at 6% pa from the date of filing the Original Application till the date of filing the appeal i.e., on 30.10.2026, comes to Rs.4,02,44,895.40p.
This amount is disputed by the Learned Counsel for Petitioner on the ground that the interest calculated at 6% per annum from the date of filing of the Original Application till the date of filing the appeal on the amount due would be much less and certainly it would not be Rs.4,02,44,895.40p.
It is further submitted that after passing of final order, the Respondent Bank has debited a sum of Rs.38.00 lakhs from the pension account of the Petitioner.
Learned Counsel for the Respondent Bank is directed to get instructions with regard to the calculation of interest and the aforesaid payment debited from the pension account of the Petitioner. List the matter on 19.11.2026. Sd/-
