O.A. No.4414/2026

O R D E R (ORAL)

By Hon’ble Mr. Mr. B. Anand, Member (A):

At the outset, learned counsel for the applicant submits that the applicant has only three months left before his retirement and has been suddenly transferred from the General Branch, East Zone (erstwhile Shahdara South Zone), to the Education Department, East Zone (erstwhile Shahdara South Zone). It is contended that such a transfer, particularly when the applicant is on the verge of retirement, is in violation of the extant transfer and posting guidelines. He further submits that the post previously occupied by the applicant has, as of now, not been filled by any other person.

2. Learned counsel for the applicant presses for grant of interim relief.

3. Issue notice to the respondents. Mr. Akshit Gupta, learned counsel, who appears for the respondents on advance service, accepts notice. He seeks some time to file a short reply to enable the Tribunal to consider the applicant's prayer for interim relief.

4. At this stage, learned counsel for the applicant submits that, since the matter pertains to transfer and posting, a direction may be issued to the respondents to decide the

applicant’s representation, upon its submission, in a time- bound manner.

5. Under the circumstances, the applicant is directed to submit a representation to the respondents within one week. Upon receipt of the said representation, the respondents are directed to consider and decide the same, in accordance with the extant rules and law on the subject, by passing a reasoned and speaking order, as expeditiously as possible and preferably within one week from the date of receipt of the representation.

6. It is made clear that this Tribunal has not gone into the merits of the case. The respondents are directed not to give effect to the impugned transfer order until the applicant’s representation is duly considered and decided by passing a reasoned and speaking order.

7. In the event the applicant fails to submit the representation within the stipulated period, the respondents shall be at liberty to take further action in accordance with the extant rules and law on the subject. Order ‘Dasti’
