SNEHA MEENA

ORDER (ORAL)

By Hon’ble Mr. Manish Garg, Member (J)

The matter is listed under the heading “For Admission (Subject to Office Objection)”. The Registry has raised objections regarding the Original Application being premature and barred by limitation. However, since the applicant has made a limited prayer for disposal of the representation, the Registry is directed to assign a regular number to the OA.

2. In the present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant seeks the following reliefs:- “a. Quash and set aside the orders 20.9.11 and 3.10.12 passed by the Respondents cancelling the candidature of the Applicant for the post of Constable Driver, Delhi Police Recruitment 2009;

b. Direct the Respondents to appoint the Applicant to the post of Constable Driver, Delhi Police, with all consequential benefits;

c. Direct the Respondents to grant the Applicant notional seniority from the date on which similarly situated / batch candidates of Recruitment 2009 were appointed;

d. Pass such other or further order(s) as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the case.”

3. At the outset, learned counsel for the applicant submits that the post-acquittal representation seeking appointment with consequential benefits, annexed as Annexure A-7, is still pending consideration before the SNEHA MEENA

respondents. He further submits that the applicant would be satisfied if a direction is issued to the respondents to dispose of the aforesaid representation by way of a reasoned and speaking order within a stipulated time frame.

4. Issue notice. Ms. D. Vijayalakshmi, learned counsel, appears and accepts notice on behalf of the respondents. She seeks some time to obtain appropriate instructions in the matter.

5. In view of the limited prayer made, without entering into the merits of the case, the present O.A. is disposed of with a direction to the respondents to consider and decide the aforesaid representation by passing a reasoned and speaking order, strictly in accordance with law, within a period of thirty (30) days from the date of receipt of a certified copy of this order.

6. A copy of the speaking order so passed shall be provided to the applicant.

7. The OA is disposed of in the aforesaid terms, without going into the merits, at the admission stage SNEHA MEENA

itself. Pending MAs, if any, shall also stand disposed of accordingly.

8. No order as to costs.
