CENTRAL ADMINISTRATIVE TRIBUNAL PRINCIPAL BENCH 61/35, COPERNICUS MARG,NEW DELHI-110001 Order Sheet Item no.: 42 M.A./4898/2026 (DELHI) [ DIRECTION ] [ SENIOR CITIZEN ] In O.A./105/2023 RETIRAL BENEFITS Court No.: 3 No of Adjournment: 1 Order Dated: 04/11/2026 NEW AND RENEWABLE ENERGY Vs GHAMMI

For Applicant(s) Advocate : Mr. Anil Mittal with Mr. Atul Chauhan (Respondents in the MA)

For Respondent(s) Advocate : Ms. Gauraan with Ms. Kanchan Chaudhary (Respondents in the OA) Order of The Tribunal MA No. 4898/2026 This MA has been filed by Respondent No. 2 seeking dismissal of the OA on grounds of jurisdiction and for other reasons.

2. Notices in the MA were issued on 01.10.2026 and four weeks' time was granted to the original applicant to file a reply. However, there is no response on record.

3. Learned counsel for Respondent No. 2 in the OA submits that they are an autonomous body and are not listed in the schedule. As such, the Tribunal does not have jurisdiction. Furthermore, the applicant in the associated OA had filed an earlier OA i.e. OA No. 708/2014, on the same cause of action. The same has since been allowed, and a review petition was preferred by the respondents therein, which was dismissed.

4. Thereafter, the matter is now pending before the Hon'ble High Court in WP No. 13536/2023 and is coming up for hearing on 21.01.2027. She that since the matter is already under active consideration, the OA itself is not maintainable even on merits.

5. Proxy counsel appearing on behalf of the applicant in the OA submits that he does not have any instructions and he would need some more time to come up with appropriate instructions.

6. Looking into the above, one last chance is granted to the applicant in the OA to come up with instructions/reply to the MA.

7. Re-list this MA along with the OA for final hearing under the same category on 30.11.2026.
