CENTRAL ADMINISTRATIVE TRIBUNAL PRINCIPAL BENCH 61/35, COPERNICUS MARG,NEW DELHI-110001 Order Sheet Item no.: 15 O.A./4366/2026 (DELHI) [ RECRUITMENT ] Court No.: 4 No of Adjournment: Order Dated: 02/11/2026 PRIYA JAIN Vs DSSSB (GNCTD)

For Applicant(s) Advocate : Mr. Setu Niket, Ms. Esha Mazumdar For Respondent(s) Advocate : Ms. Punam Singh, Ms. Varmika Singh, Mr. Amit Anand Order of The Tribunal In the instant O.A., the applicant is seeking the following reliefs: "A. Call for records of the case; B. Quash or set aside Result Notice No. 1659 dated 17.09.2026 to the extent that it excludes the Applicant from consideration/allocation for the post of Assistant Teacher (Nursery) (Female) in MCD; C. Direct the Respondents to allow the Applicant to record her preference for MCD and to process her e-dossier for consideration; D. Direct the Respondents to forward the Applicant’s e-dossier to MCD for document verification and appointment for the post of Assistant Teacher (Nursery) (Female) according to the applicable rules; E. Direct Respondents to appoint the Applicant to the post of Assistant Teacher (Nursery) (Female) in MCD with all consequential benefits including arrears of pay, seniority etc. with interest at GPF rates; F. Award costs of the proceedings;

G. Pass any order/ relief/ direction(s) as this Hon’ble Tribunal may deem fit and proper in the interests of justice in favour of the Applicant." Learned counsel for the applicant also presses for interim relief in terms of para 9 of the O.A., which reads as under: "A. Pass an order directing Respondents to keep one post of Assistant Teacher (Nursery) (Female) vacant till the pendency of the present Original Application; B. Pass any order/ relief/ direction(s) as this Hon’ble Tribunal may deem fit and proper in the interest of justice in favour of the Applicant." Learned counsel for the applicant submits that, while submitting the online application, the applicant had exercised only one preference, namely, NDMC, for the post in question. He draws attention to Clause 5 of the advertisement, which contemplated the exercise of post preference at the post-examination stage, i.e., at the time of submission of the e- dossier. He submits that the applicant was not accorded such an opportunity. He further submits that the applicant has secured a total of 143.96 marks, which is higher than the final cut-off marks prescribed for the MCD department. Opposing the grant of interim relief, learned counsel for the respondents seeks time to take appropriate instructions. He submits that the preferences have already been accorded to the applicant in terms of the advertisement and that no further opportunity to exercise preferences can be granted. Be that as it may, without prejudice to the rights and contentions of the parties, a prima facie case appears to have been made out in favour of the applicant. The balance of convenience also appears to lie in her favour. Accordingly, the respondents are directed to keep one post of Assistant Teacher (Nursery) (Female) vacant during the pendency of the present Original Application.

The respondents are directed to file their reply within two weeks. Re-notify on 07.12.2026.
