ORAL ORDER

(As per Hon’ble Mr. Manish Garg, Judicial Member)

The instant O.A. is filed by the applicant, seeking the following relief: “.............to declare the action of the Respondents in failing to maintain, produce and operate the PwBD reservation roster from 2016 onwards, denying the Applicant her rightful promotion and consequential benefits, and repeatedly posting her to distant stations without considering her 50% benchmark disability, serious medical condition and spouse grounds, as illegal, arbitrary, discriminatory and violative of Articles 14 and 16 of the Constitution of India and the Rights of Persons with Disabilities Act, 2016; consequently, direct the Respondents to produce and reconstruct the PwBD roster from 2016 onwards, review the relevant promotion panels and grant the Applicant promotion to the post of Private Secretary from the legally due date with consequential seniority, pay fixation and admissible benefits; set aside the promotion/posting proceedings dated 30.01.2026 and the latest promotion-cum-posting order dated 28.09.2026, insofar as they adversely affect the Applicant’s lawful rights and direct her posting outside Secunderabad; and consequently direct the Respondents to promote, post and retain the Applicant at CQA(S), Secunderabad without compelling her to accept an outstation posting as a condition of promotion, holding that departmental lapses in maintaining the roster or the Applicant’s earlier inability to question such irregularities cannot defeat her lawful service rights; in the alternative, if no suitable sanctioned vacancy is available at Secunderabad, direct the respondents to consider creating or accommodating the Applicant against a supernumerary or equivalent temporary post there, in accordance with the applicable rules and without prejudice to the rights of other employees; and pass such other order or orders as this Hon’ble Tribunal may deem fit and proper in the circumstances of the case.”

2. Highlighting the facts of the case, learned counsel for the applicant submits that the Applicant, appointed in 1999 under the physically handicapped category (disability now certified at 50%), was transferred on compassionate

grounds to Medak in 2008, forgoing seniority, and to CQA(S), Secunderabad in 2011. Promoted as Personal Assistant in 2016, she states the PwBD roster point and vacancy records were never disclosed. Placed at Sl. No. 6 in the 2025 panel, she was promoted and posted to CQA(V), Ahmednagar on 31.12.2024 but, on medical grounds, was allowed to defer it for a year. In the 2026 panel, she was placed at Sl. No. 12, and Respondent No. 5 was promoted at Secunderabad w.e.f. 01.02.2026. On 22.01.2026 the Chief Commissioner for Persons with Disabilities noted that roster evidence had not been shared and called for records. After a further order dt. 28.09.2026 posting her to Bengaluru, she made a consolidated representation on 04.10.2026. She seeks production or reconstruction of the PwBD roster from 2016, review of the panels, promotion from the legally due date with benefits, and posting or retention at Secunderabad, including supernumerary placement, if the rules permit.

3. Mr. V. Vinod Kumar, learned Senior Panel Counsel appears on behalf of the respondents and opposes the relief sought in the O.A.

4. Learned Senior Counsel appearing on behalf of the applicant relies upon the judgment dated 11.08.2022 in Net Ram Yadav vs The State of Rajasthan {[2022] 7 S.C.R. 101}.

5. Considering the fact that the representation dated 04.10.2026 is pending with the respondents, we are of the opinion that the O.A. can be disposed of at the admission stage, directing the respondents to dispose of the said representation by a reasoned and speaking order, within a period of thirty (30) days from the date of receipt of a copy of this order, following the principles of
