CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 5 O.A./387/2026 (BANGALORE) [ TRANSFER ] With M.A./389/2026 FOR IMPLEADING RESPONDENT Court No.: 2 No of Adjournment: 3 Order Dated: 06/11/2026 SRIKANTH M Vs DEPTT OF POSTS

For Applicant(s) Advocate : Shri P. Kamalesan- through video conference For Respondent(s) Advocate : Shri S. Sugumaran for Respondent Nos. 1 to 5 - through video conference, None for Respondent No. 6 Order of The Tribunal

Shri P. Kamalesan appears on behalf of the applicant through video conference. Shri S. Sugumaran appears on behalf of the Respondent Nos. 1 to 5 through video conference. None appears on behalf of Respondent No. 6. It is seen that Respondent No. 6, who is party in person has filed a reply. He is requested to furnish hard copy of the reply to the counsel for the applicant in the next one week. The counsel for respondent Nos. 1 to 5 submits that the applicant has already joined at the new place of posting and new place of posting is just 3.5 kms away from the earlier place. The same is strongly opposed by the learned counsel for the applicant saying that there are certain judgements which say that transfer cannot be carried out on account of misconduct of the employee.

By consent, it is decided to hear on the issue of Interim Relief on the next date of hearing. The learned counsel for the respondent Nos. 1 to 5 says that he will go through the rejoinder and file an additional reply, if required, along with an MA in the next two weeks. List the case on 07.12.2026.
