O R D E R

[ORAL]

Per Justice Narendra Kumar Johari, Judicial Member:- Heard the learned counsel for the parties.

3. Earlier OA No. 102/2024 was filed by Shri Rahul Kumar Dubey (applicant of this OA) which was decided by this Tribunal vide order dated 15.03.2024 by directing the respondents to consider his case for compassionate appointment. Subsequently, this order of the Tribunal was challenged by Prabha Devi and Sunita Dubey before the Hon’ble Jharkhand High Court at Ranchi in W.P.(S) No. 5617 of 2024 alleging that they are the first wife and daughter of the deceased Hari Raj Dubey. Hon’ble High Court vide order dated 21.10.2024 set aside the order of this Tribunal passed on 15.03.2024 and directed the applicant to implead Prabha Devi and Sunita Dubey as Opposite Party and Hon’ble Court has remitted the OA for adjudication afresh to the issue.

4. Learned counsel instead of proceeding as per direction of Hon’ble High Court in the aforesaid OA No. 102/2024 filed another OA No. 56/2025 by impleading Prabha Devi and Sunita Dubey as Opposite Parties. On the other hand, Prabha Devi has also filed another OA No. 444/2026.

5. Counsel for the applicant has submitted that inadvertently and by mistake the OA No. 56/2025 was filed instead of proceeding in the earlier OA No. 102/2024. It is submitted that since this OA has been filed wrongly by the applicant, therefore he has submitted MA No. 621/2026 to withdraw the present OA.

6. Counsel for the Opposite Party has not objected.

7. In view of the above, MA No. 621/2026 is allowed and OA No. 56/2025 is hereby dismissed as withdrawn. Sd/- Sd/- (Kumar Rajesh Chandra) (Justice Narendra Kumar Johari) Member (A) Member(J) Srk. Digitally signed by SURYAROOP KABI SURYAR OOP KABI
