CENTRAL ADMINISTRATIVE TRIBUNAL PATNA Order Sheet Item no.: 17 O.A./606/2026 (RANCHI) [ APPOINTMENT ] Court No.: 1 No of Adjournment: 1 Order Dated: 05/11/2026 PRANAV KUMAR Vs DEPTT OF POSTS

For Applicant(s) Advocate : Shri Abhijeet Kumar For Respondent(s) Advocate : Shri Amit Sinha, ASC Order of The Tribunal Learned counsel for both sides are present. Heard the learned counsel for the applicant in MA No. 496/2026 which is filed for condonation of delay in filing the OA. Reply to the said MA has been filed by the counsel for the Opposite Party. Counsel for the applicant has submitted that MA No. 496 of 2026 has been filed for condonation of delay of 607 days in preferring the OA. He has further submitted that although has not been given appointment on scheduled date of reporting, i.e. 06.11.2023 yet approached to the authorities concerned through Centrallized Public Grievance Redress and Monitoring System. He has got the reply that some other person Sarwan Kumar had already been appointed as ABPM in the place of posting, i.e. Tiliapara. Counsel for the applicant further mentioned that as per para 3.1 of the advertiment regarding preference of posts, the authorities have sought the order of preferences from the candidates. The applicant has given 38 places of posting in order of preference. Therefore, if one post was not available for applicant in order of preference it was the duty of the authorities to provide another place of posting but the authorities concerned did not take pain and they have not given any such posting to the applicant. The applicant was running from pillar to post through representations, RTIs etc, but the authorities have not given any reply towards the grievance of the applicant. The applicant has still not been given appointment in respect of his selection. Accordingly, cause of action remains continued. Counsel for the Opposite Party has replied that the OA has been filed by the applicant after a delay of more than 900 days which is against provision of Section 20(1) of the Administrative Tribunals Act, 1985. After hearing the learned counsel for the parties, we are of the view that grounds mentioned in MA No. 496/2026 are sufficient as the cause of action is continuing till now. In view of the above, MA No. 496 of 2026 is allowed and the delay in filing the OA is hereby condoned. Let the OA be put up on 06.11.2026 for consideration.
