[By Advocate : Mr. Sreejith N] The Contempt Petitions having been heard on 28.10.2026, the Tribunal on the same day delivered the following:

C O M M O N O R D E R (Oral):- Per: . Justice Sunil Thomas, Judicial Member Heard all the learned Counsel for the petitioners, learned Senior Counsel and the learned Standing Counsel appearing for the Railways.
2. It is admitted by the learned Counsel for the petitioners that the grievances have been redressed in relation to substantial number of petitioners. However, it is contended by the learned Counsel for the petitioners that since the order rescinding the MACP granted to them stands set aside, the petitioners are entitled for the 3rd MACP. In the nature of the above reliefs granted by this Tribunal and affirmed by the Hon'ble Supreme Court, we feel that no further claim can survive in these CPs. It has to be based on consideration of the facts involved in individual cases and service records of the petitioners. In such cases, the petitioners who claim to be entitled to the 3rd MACP may make individual representations to the Railways within a period of three weeks from the date of receipt of a copy of this order, whereupon the Railways shall pass appropriate orders on such representations within a period of three months thereafter. We are leaving that issue open to be considered at the appropriate stage.

3. The further grievance of the petitioners is that in the case of some petitioners, revised PPOs have not been issued. In certain cases, revised PPO shows Level 6 instead of Level 7. In certain other cases, arrears have not been paid, it is submitted.
4. In the above circumstances, we are inclined to direct the Railways to consider the above and issue revised PPOs wherever required and to release the entire arrears due and satisfy the order full in relation to all the petitioners, within a period of three months from the date of receipt a copy of the order. If in any individual case, the order remains unimplemented fully, the right of such petitioners to revive the CPs stand reserved.
5. With these observations, the Contempt Petitions are closed. Notices stand discharged. No costs. (Dated, 28th October, 2026) V. RAMA MATHEW JUSTICE SUNIL THOMAS ADMINISTRATIVE MEMBER JUDICIAL MEMBER ax
