ORDER

MA No.1090/2025 in OA No.899/2025 and MA No.1089/2025 in OA No.898/2025 have been filed by the applicants for Joint Petition. For the reasons stated therein in the MAs, the same are allowed.

2. At the outset, both the learned counsel for the parties submit that the issue involved in the

Alphanso Reason: I am the author of this document Location:

3. By filing OA No.899/2025, the applicants have prayed for following reliefs: “8(a) This Hon’ble Tribunal may graciously be pleased to call for the records of the case from the respondents and after examining the same, be pleased to direct the respondents to consider the case of the applicants for ICT, as requested by the applicants in their application and issue necessary orders of ICT as directed by this Hon’ble Tribunal in Original Application No.124 of with all consequential benefits.

(b) Costs of the application be provided for.

(c) Any other and further order as this Hon’ble Tribunal deems fit in the nature and circumstances of the case be passed.”

4. It is the case of the applicants that they are praying for their Inter-Charge Transfer (ICT) in accordance with the policy dated 14.05.1990 under which they have applied for Inter-Charge Transfer. It is submitted that their applications are duly forwarded to the respective regions but could not be acted upon owing to non-availability of vacancies at the relevant time. Subsequently, the said ICT policy came to be withdrawn and kept in abeyance vide order dated

22.12.2020.

5. It is stated that the Co-ordinate Benches of this Tribunal, in series of decisions, have categorically held that employees who had applied for ICT prior to 22.12.2020 are entitled to consideration under the policy dated 14.05.1990 and that the subsequent withdrawal order dated 22.12.2020 cannot operate retrospectively to their detriment.

6. It is submitted that the applicants, being similarly situated, are also entitled to the same benefit, since their ICT applications were forwarded well before the withdrawal of the policy. The applicants have already submitted representations seeking extension of similar benefits in terms of the aforesaid judgements, however, no decision has been taken thereon, therefore, they have constrained to approach this Tribunal by way of the present OAs.

7. After issuance of notice, the respondents have filed their reply and contested the OAs.

8. During course of the arguments, learned counsel for the applicants submits that the present OAs can be disposed of on the basis of the order passed

Milan Jackson Alphanso by this Tribunal in OA No.124/2021 in the case of Rakesh Bahadur & Ors. Vs. Union of India, CBDT, New Delhi decided on 05.03.2024, as according to him, the cases of the present applicants are similar to that of the applicants of the said OA.

9. On the other hand, learned counsel for the respondents submits that against the said order, the department has preferred Writ Petition (L) No.6394/2026 before the Hon’ble Bombay High Court which is pending.

10. However, both the learned counsel for the parties fairly submit that there is no stay in respect of the order passed by this Tribunal on 05.03.2024.

11. Taking into the aforesaid order of the Tribunal and the fact that the applicants are praying only for consideration case in light of the order passed by this Tribunal in OA No.124/2021, the present OAs are disposed of with direction to the competent authority of the respondents to consider and decide the pending representations of the applicants as per rules and keeping in view of the observations made in the case of Rakesh Bahadur and Ors. (supra), within a period of 60 days from the date of receipt of a

certified copy of the order.

12. It is made clear that this Tribunal has not considered the cases of the present applicants on merits.

13. With the aforesaid order/directions, the Original Applications stand disposed of. Pending MAs, if any, stand closed. No costs.
