CENTRAL ADMINISTRATIVE TRIBUNAL MUMBAI Order Sheet Item no.: 2 O.A./884/2026 (MUMBAI) [ ALLOTMENT OF QTR ] Court No.: 1 No of Adjournment: Order Dated: 06/11/2026 SURAJ ANANT VIBHUTE Vs WESTERN RAILWAY
For Applicant(s) Advocate : Shri V.A. Nagrani For Respondent(s) Advocate : Mrs. N.V. Masurkar Order of The Tribunal Heard Shri Nagrani, learned counsel for the applicant.
2. Issue notice to the respondents. Mrs. N.V. Masurkar, learned counsel appears on advance notice on behalf of the respondents and waives service. Heard her also on interim relief.
3. The applicant seeks to antedate his eligibility for allotment of quarters. It is submitted that he had applied for Type IV quarter on 28th June, 2021 and his name was included in the waiting list for allotment of quarters. It is claimed that subsequently, the respondents came out with a circular, stating that re- registration was required to be done through E-Karmic and those who do not register would be presumed to be not interested in obtaining a quarter, and his/her name would be stuck off from the waiting list. It is the claim of the applicant that the said circular was not brought to his notice, so as to enable him to re-register through E-Karmic.
4. It is further submitted that no cut-off date has been given in the said notification. It is also contended that the circular was not applicable for Workshop employees but only for the employees at the Headquarters. It is further submitted that there is an urgency, as although the applicant is presently occupying a Type-II quarter, if his original date of application for allotment is considered, he would be the next in line for allotment of a quarter.
5. Learned counsel for the respondents submits that she requires time to file reply.
6. This Bench also asked learned counsel for the applicant to place on record the relevant rules governing allotment of quarters and seniority, particularly whether the seniority for allotment is determined from the date of application or from the date of eligibility to a particular quarter. The rules governing allotment of quarters have not been placed on record.
7. Learned counsel for the respondents as well as the applicant shall place on record the relevant rules governing the determination of seniority for allotment of quarters.
8. Stand over to 19th November, 2026 for reply by the respondents and hearing on interim relief.
