CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 11 Diary No: 6907/2026 [ PROMOTION ] Court No.: 3 No of Adjournment: 1 Order Dated: 06/11/2026 RAHUL KUMAR Vs RAILWAY BOARD
For Applicant(s) Advocate :
For Respondent(s) Advocate : Order of The Tribunal Shri Ashish Srivastava, learned counsel for the applicant and Shri M.K. Sharma, learned counsel for the respondents are present. Counsel for the applicant submitted that, in pursuance of the judgment passed by the Hon’ble Supreme Court in Siddaraju vs. State of Karnataka , the Department of Personnel and Training (DoPT) issued an Office Memorandum dated 17.05.2022 regarding the grant of benefits to Persons with Benchmark Disabilities (PwBD). In compliance with the said OM, the Railway Board issued instructions to all Zonal Railways and Production Units. Learned counsel further drew attention to the Railway Board's letter dated 15.01.2025, whereby all Zonal Railways and Production Units were directed to take immediate steps for the creation of supernumerary posts to extend notional promotional benefits to PwBD employees. It was submitted that BLW, being one of the Production Units, was also required to comply with the said instructions, and the concerned authorities were directed to submit their proposals by 31.01.2025. However, the BLW authorities failed to submit the requisite proposal within the stipulated period and furnished the information belatedly on 17.10.2025. Consequently, PwBD employees working in BLW were deprived of the aforesaid benefits. Learned counsel further submitted that the Railway Board, vide its letter dated 04.05.2026, did not take appropriate cognizance of the proposal for creation of additional supernumerary posts in BLW to extend the benefit of notional promotion to PwBD employees with effect from 30.06.2016. Being aggrieved by the inaction of the respondents and seeking the same benefits contemplated under the DoPT OM dated 17.05.2022 and the Railway Board's instructions dated 15.01.2025, the applicants have approached this Tribunal. Matter requires consideration. The respondents are directed to file a short counter affidavit specifically explaining the steps taken for the creation of supernumerary posts in BLW and the reasons for non-creation of such posts for extending the benefit of notional promotion to eligible PwBD employees, within a period of three weeks. List this matter on 18.12.2026.
