CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 10 O.A./1293/2026 (ALLAHABAD) [ PROMOTION ] Court No.: 3 No of Adjournment: Order Dated: 06/11/2026 ASHISH KUMAR YADAV Vs RAILWAY BOARD

For Applicant(s) Advocate :

For Respondent(s) Advocate : Order of The Tribunal Shri Rakesh Kumar Dixit, learned counsel for the applicant and Shri Anil Kumar, learned counsel for the respondents are present. M.A. No. 6020/2026 (Joint Application). This is an application filed under section 4(5) filed by the counsel for the applicants seeking permission to pursue the case jointly. Since the cause of action and relief claimed by all the applicants are similar, therefore, M.A. No. 6020/2026 u/r 4(5) is allowed accordingly, the applicants are permitted to pursue the case jointly. Order in OA Learned counsel for the applicant submitted that the applicant has challenged the impugned eligibility lists dated 15.09.2026 and 16.09.2026, as well as the speaking order dated 21.10.2026, pertaining to the suitability of candidates for the post of Senior Clerk-cum-Typist in Level-5. The grievance raised by the applicant is that the respondents have initiated the process of merger of the ministerial cadres of different departments into a single cadre. It is submitted that the process initiated by the respondents for filling up the posts of Senior Clerk in Level-5 (Grade Pay of Rs. 2800/-) under the 66?% promotional quota, without properly determining the inter se seniority of employees in their respective grades and cadres, may result in anomalies and discrimination among similarly situated employees working in different departments, particularly the Engineering Department and the Personnel Department. The applicant has, therefore, sought interim protection in this regard. Learned counsel for the respondents is directed to seek instructions in the matter and apprise this Tribunal accordingly within a period of two weeks. List this matter on 30.11.2026 for consideration of the prayer for interim relief.
