CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 35 M.A./2764/2024 (ALLAHABAD) [ EXECUTION APPL ] In O.A./435/2015 SENIORITY With M.A./1498/2025 DISCHARGE APPL M.A./881/2026 DISCHARGE APPL Court No.: 3 No of Adjournment: 27 Order Dated: 06/11/2026 KESHAV DEV Vs M/O DEFENCE

For Applicant(s) Advocate : Shri O P Gupta For Respondent(s) Advocate : Shri Krishna Kumar Ojha Order of The Tribunal Shri O.P. Gupta, learned counsel for the applicant, and Shri Krishna Kumar Ojha, learned counsel for the respondents, are present and heard. Beside the direction given by this Tribunal, the personal appearance of Lieutenant Colonel Manoj Kumar is not exempted. Learned counsel for the respondents submits that intimation has been given to Lieutenant Colonel Manoj Kumar, the competent authority in the present case. However, he is not present before this Tribunal. Learned counsel further submits that an affidavit of compliance, along with an application seeking exemption from personal appearance, has been filed.

Learned counsel for the applicant vehemently objects to the submissions made on behalf of the respondents and contends that no compliance has been made. He further submits that the affidavit filed by the respondents pertains only to the fact that the SLP filed by the respondents' department has been taken note of therein and does not establish compliance with the directions issued by this Tribunal. It is made clear that in the event Lieutenant Colonel Manoj Kumar fails to appear before this Tribunal on the next date of hearing, a bailable warrant shall be issued. List this case on 18.11.2026.
