CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 8 O.A./1279/2026 (ALLAHABAD) [ SENIORITY ] With M.A./5964/2026 JOINT APPL Court No.: 3 No of Adjournment: Order Dated: 05/11/2026 HARI SINGH SISODIYA Vs NORTH CENTRAL RAILWAY
For Applicant(s) Advocate :
For Respondent(s) Advocate : Order of The Tribunal Mr. R.K. Dixit, learned counsel for the applicants, and Mr. Anil Kumar, learned counsel for the respondents, are present and heard. Learned counsel for the applicants submitted that, in pursuance of Railway Board letter dated 14.12.2023 (RBE No. 137/2023), the respondents issued a notification dated 10.04.2026 inviting applications for transfer/absorption of eligible Track Maintainers Grade-IV/Level-I working in the Engineering Department against 10% quota vacancies in other departments of the Railways. Learned counsel for the applicants further submitted that the applicants were initially appointed as Track Maintainers during the years 2012 and 2013 and submitted their applications within the prescribed time. However, in the inter-se seniority list dated 08.10.2026, issued for considering eligible employees for transfer/absorption under the aforesaid 10% quota, the dates of initial appointment of the applicants have been incorrectly recorded. He submitted that, as per their service records, the applicants were initially appointed on different dates during the years 2012 and 2013, whereas the impugned seniority list reflects incorrect dates of appointment, thereby adversely affecting their seniority positions and chances of consideration against the notified vacancies. He further submitted that the respondents issued a letter dated 12.10.2026 calling 40 allegedly eligible employees for medical examination. Thereafter, the applicants submitted a detailed representation dated 14.10.2026 before the competent authority, pointing out the discrepancies in their dates of initial appointment and requesting correction of the inter-se seniority list on the basis of their actual dates of appointment. The said representation was forwarded to the competent authority on 15.10.2026. However, no decision has been taken on the said representation. Learned counsel for the applicants, therefore, submitted that if their actual dates of initial appointment are taken into consideration and their inter-se seniority is correctly determined, their positions in the seniority list would improve, thereby enabling their consideration for transfer/absorption against the vacancies notified under the 10% quota in other departments of the Railways. The matter requires consideration. Accordingly, learned counsel for the respondents is directed to seek instructions in the matter within two weeks. List this case on 04.12.2026.
