CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 17 O.A./1258/2026 (ALLAHABAD) [ PROMOTION ] Court No.: 3 No of Adjournment: 1 Order Dated: 05/11/2026 ARUN SINGH TOMAR Vs NORTH CENTRAL RAILWAY

For Applicant(s) Advocate :

For Respondent(s) Advocate : Order of The Tribunal Mr. R.K. Dixit, learned counsel for the applicant, and Mr. Anil Kumar, learned counsel for the respondents, are present and heard. Learned counsel for the applicant submitted that, vide suitability list dated 08.10.2026, the respondents have notified the zone of consideration for promotion to the post of Senior Goods Train Manager (Level-6) against 86 vacancies. He further submitted that the applicant, who belongs to the General Category, is placed at Sl. No. 71 in the seniority list dated 23.01.2026, whereas several private respondents, whose names have been included in the suitability list, are junior to him and are placed at serial numbers ranging from 73 to 211 in the seniority list. However, the applicant has been shown as not suitable, whereas such junior candidates belonging to the reserved categories have been included in the list of suitable candidates. He, therefore, contended that the preparation of the suitability list is contrary to the prescribed roster points and the applicable instructions governing promotion. He further submitted that the applicant has already submitted a representation dated 16.10.2026, but no decision has been taken thereon by the respondents. The matter requires consideration. Accordingly, learned counsel for the respondents is directed to apprise this Tribunal of the factual position regarding the seniority of the applicant vis-a-vis the reserved category candidates who, despite being junior to the applicant, have been included in the zone of consideration and to explain the basis on which such candidates have been included in the suitability list while the applicant has been excluded. Learned counsel for the respondents is further directed to file a short counter affidavit addressing the aforesaid issues within three weeks. Learned counsel for the respondents has rendered valuable assistance on the issue of reservation in promotion by referring to the judgments of the Hon’ble Supreme Court in R.K. Sabharwal, M. Nagaraj and Jarnail Singh cases. The legal position and its applicability to the facts of the present case shall also be addressed by the respondents in their short counter affidavit. List this case on 22.12.2026. Ms Manju Pandey Member (A) Rajnish Kumar Rai Member (J) Shakuntala Singh ( steno 'c' )
