CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD Order Sheet Item no.: 5 O.A./1269/2026 (ALLAHABAD) [ SELECTION/PROMOTION ] Court No.: 3 No of Adjournment: Order Dated: 04/11/2026 DHARTI PAL SINGH Vs NORTH CENTRAL RAILWAY

For Applicant(s) Advocate :

For Respondent(s) Advocate : Order of The Tribunal Mr. R.K. Dixit, learned counsel for the applicant, and Mr. Anil Kumar, learned counsel for the respondents, are present and heard. Order on M.A. No. 5939/2026 (Joint Application) Present M.A. has been filed by the applicants under Rule 4(5) of CAT (Procedure), Rules 1987, seeking permission to pursue the case jointly as the cause and nature are similar. Since the cause of action and relief sought by the applicants are same and similar, M.A. No.5939/2026 is allowed for the reasons stated therein. Accordingly, the applicants are permitted to pursue the case jointly. Order in O.A. No. 1269/2026 Learned counsel for the applicants submitted that the present Original Application has been filed challenging the final selection panel dated 19.10.2026 issued for the post of Commercial-cum-Ticket Clerk (Level-3, GP Rs. 2,000/-) under the 33?% quota against 26 vacancies.

He submitted that the selection process was conducted pursuant to the notification dated 12.11.2025. He further submitted that, as per the prescribed selection procedure, the respondents were required to publish the answer keys and invite objections before finalising the selection panel. However, the applicants alleged that the selection panel was issued without following the prescribed procedure and without ensuring transparency in the selection process. Learned counsel further submitted that, after examining the question booklets, answer keys and OMR sheets, the applicants found that they had secured higher marks than certain selected candidates. In support of their claim, they have placed on record the question booklets, answer keys and OMR sheets of the applicants as well as the last selected candidates. He, therefore, contended that candidates securing higher marks have been left out of the final selection panel, whereas candidates securing lower marks have been selected. The applicants have also submitted a representation dated 22.10.2026 before the respondents in this regard. Accordingly, learned counsel for the respondents is directed to file a short counter affidavit specifically explaining the allegations made in the Original Application, particularly with regard to the claim of the applicants that they have secured higher marks than the last selected candidates. The respondents shall revisit and re-examine the OMR sheets of the applicants vis-a-vis those of the last selected candidates and apprise this Tribunal of the factual position. Meanwhile, it is open to the respondents to consider and decide the representation submitted by the applicants by passing a reasoned and speaking order. List this matter for admission on 10.12.2026.
