CIVIL APPEAL 141 of 2009 on 27 August 2009

17.01.2022.Ct.No.29.AS.3.

C.R.R. 1124 of 2010

In the matter of : M/s. Anil Credit Commercial (P) Ltd. … Petitioner.

Mr. Madhusudan Sur, ld. A.P.P.,Mr. Dipankar Paramanick.

…for the State.

Learned Advocate on behalf of the State appears.

Proper authority is requested to regularize the appointmentof Mr. Madhusudan Sur and Mr. Dipankar Paramanick, learnedAdvocates.

On careful perusal of the of the instant revisionalapplication, I find that the petitioner has challenged the orderpassed in Criminal Revision No.141 of 2009 dated 12.1.2010whereby the learned Additional District & Sessions Judge, 9[th]Fast Track Court allowed the revisional application and orderdated 27.8.2009 passed by the learned Metropolitan Magistrate,12[th] Court, Calcutta was set aside and direction was passed forissuing fresh summons upon the petitioner, Swapan SadhanBose.

After careful perusal of the record, I find that in spite ofspecific direction by this Court on 12.4.2010, petitioner takes nosteps by filing of affidavit of service.

Now after careful perusal of the judgement itself passed inCriminal Revision No.141 of 2009, I do not find any irregularityand/or irregularity to interfere.

Thus the revisional application stands dismissed.
