Calcutta High Court

WRIT PETITION None on 7 December 2018

S/L No.26 12.08.2022 Ct-29 (AD)

CPAN 883 of 2021 in WPA 23661 of 2018

Becharam Nandi & Ors.

vs.

Dr. P. Deepap Priya

Mr. Panchanan Hajra

…for the petitioners.

Mr. Soumitra Bandyopadhyay Mr. Priyabrata Batabyal … for the alleged contemnor.

Petitioners complain of the violation of the order dated December 7, 2018.

By such order, respondent no.3 in the writ petition was directed to consider and decide the representation made by the petitioners in accordance with law.

Alleged Contemnor is represented.

On behalf of the alleged contemnor, an order dated April 9, 2019 is relied upon.

Apparently, the authorities acted in terms of the order dated December 7, 2018.

It is contended on behalf of the petitioners that the order dated April 9, 2019 is not in accordance with the order dated December 7, 2018 passed by the High Court.

In view of the alleged contemnor passing the order dated April 9, 2019, it cannot be said that the alleged contemnor acted in wilful violation of the order of the High Court.

The contentions with regard to the order dated April 9, 2019 are kept open.

CPAN 883 of 2021 is disposed of accordingly.
