Director, Finance & Accounts on 30.9.94. Since he has already retired, the grievance with regard to seniority is of no consequence now. Mr. A.R.Mehta submits and states that all the retiral dues have already been paid to the petitioner and nothing remains outstanding. It is also submitted that this Special Civil Application was essentially directed against petitioner's transfer order dated 11.3.85 and after retirement now there is no question of agitating against the transfer order. This Special Civil Application has virtually become infructuous. It appears from the order dated 18.8.86 passed by the Court that some points with regard to the challenge to the fixation of seniority only were required to be considered.

Whereas this Special Civil Application has become infructuous, the same is hereby dismissed as having become infructuous. The Rule is hereby discharged. Interim order, if any, shall stand automatically vacated. No order as to costs.
