Present:

Mr. Anil Thakur, Proxy Counsel, for the petitioner.

Mr. P.M. Negi, Additional Advocate General with Mr. Ramesh Thakur, Deputy Advocate General, for the respondent-State.

Cr.MP No. 1473 of 2016

By way of instant application filed under Section 482 of Cr.PC, applicant-petitioner has prayed for extension of time to comply with the order dated 25.10.2016, whereby this Court while relying upon the report of the Probation Officer, ordered to release the petitioner by giving him the benefit of Probation subject to his furnishing bonds in terms of Sections 4 (3) and (4) of the Probation of Offenders Act, 1958, within a period of fifteen days.

Perusal of averments contained in the application suggests that the petitioner-applicant could not comply with the directions contained in order dated 25.10.2016, as the copy of the order was received by his counsel in the second week of November, 2016 and since applicant petitioner was out of station, no intimation with regard to passing of aforesaid orders could be given to him, as a result of which, he was unable to do the needful in terms of order dated 25.10.2016 passed by this Court.

In view of the above, present application is allowed and the applicant-petitioner is directed to do the needful within a period of further two weeks, failing which, he shall render himself liable to serve the sentence as imposed by the learned trial Court. The application is disposed of accordingly.
