SPECIAL CRIMINAL APPLICATION No 1538 of 1996

For Approval and Signature:

Hon'ble THE CHIEF JUSTICE G.D.KAMAT

============================================================ -------------------------------------------------------------- BALVANTBHAI GOPALBHAI

Versus

STATE OF GUJARAT

-------------------------------------------------------------- Appearance:

MS SUBHADRA G PATEL for Petitioner

PUBLIC PROSECUTOR for Respondent No. 1

-------------------------------------------------------------- CORAM : THE CHIEF JUSTICE G.D.KAMAT Date of decision: 27/11/96

ORAL JUDGEMENT

Rule. Shri Pujari, learned APP, waives service of rule on behalf of the respondents. By consent to be heard forthwith.

Petitioner is convicted under Section 302 of the Indian Penal Code and sentenced to life imprisonment. He has already undergone sentence of 7 years, 7 months and 16 days or thereabout. He applied for first furlough by his application dated 15th November, 1995.

Across the Bar, Shri Pujari has made a statement that the Inspector General of Prisons would duly consider the application within two weeks from today and decide the same in accordance with law. In my view, no specific direction is required except to hold that the Inspector General of Prisons to act accordingly. Rule accordingly is made absolute, as indicated.
