Cr.M.P.(M) No.1320 of 2008.

26.12.2008. Present: Mr.Sanjeev Bhushan, counsel for the petitioners.

Ms.Shubh Mahajan, Dy.A.G., for the respondent-State. SI Baldev Thakur, SHO, Police Station Darlaghat, District Solan, is present alongwith the records of the case.

This order shall dispose of an application filed by the petitioners under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail in FIR No.100 of 2008, dated 17.12.2008, registered at Police Station Darlaghat, Tehsil Arki, District Solan, H.P.

I have heard the learned counsel for the petitioners and the learned Deputy Advocate General for the respondent-State.

A perusal of the complaint filed by the complainant shows that she had lodged the complaint against her husband petitioner No.5 and her other in-laws under Section 498-A/506-B of the Indian Penal Code. The case was registered on a written complaint presented by the complainant on 17.12.2008 making allegations with regard to demand of dowry and threat to take her life.

I have gone through the assertions made in the petition and other record. The petitioners are no more required for effecting any recovery(s) from them at their instance. Accordingly, the application is allowed and it is ordered that in the event of their arrest, they shall be released on bail on each of them furnishing personal bonds and surety bonds in the sum of Rs.10,000/- each to the satisfaction of the I.O./SHO, Police Station Darlaghat. However, the petitioners are directed to join investigation as and when they are called by the police to do so.

The application stands disposed of accordingly.
