By way of this writ petition, the petitioner has sought the issuance ofa direction to the respondents to pay him the arrears of pay from the date ofnotional promotion or from the date other junior promoted Service Lab.Attendants have been paid.

It is the case of the petitioner that he was promoted notionally witheffect from 26.11.1985 vide order Annexure P-1 on the basis of a judgment ofthis Court passed on 6.1.2003 in C.W.P.No.7586 of 1999 and other connectedmatters but consequential service benefits were denied, whereas similarlysituated Senior Lab Attendants who were also affected by the aforesaidjudgment were paid arrears of pay with effect from 26.11.1993 and the petitionerwas made to suffer by withholding his pay fixation benefits etc.

It is not in dispute that Mohinder Singh and Amarjit Singh who werealso similarly situated as the petitioner, were promoted with effect from26.11.1985 notionally vide Annexures P-3 and P-4. From perusal of promotionorders of these persons, it is clearly made out that they were not entitled toarrears of pay.

Thus, I find no merit in this writ petition.

Dismissed.
