SPECIAL CRIMINAL APPLICATION No 1539 of 1996

For Approval and Signature: Hon'ble THE CHIEF JUSTICE G.D.KAMAT ============================================================ -------------------------------------------------------------- LILSINGBHAI CHHOTABHAI PAGIVersus STATE OF GUJARAT -------------------------------------------------------------- Appearance: MS SUBHADRA G PATEL for Petitioner PUBLIC PROSECUTOR for Respondent No. 1

-------------------------------------------------------------- CORAM : THE CHIEF JUSTICE G.D.KAMAT Date of decision: 27/11/96

ORAL JUDGEMENT

Rule. Mr.L.R. Pujari, learned APP, waives service of rule on behalf of the respondents. By consent, to be heard forthwith.

Applicant, petitoner in this petition, prays for grant of furlough due to him. It appears that he applied by his application dated 27th of May, 1996 and makes a grievance that the same has not been decided so far by the Inspector General of Prisons. Needless to say that since the petitoner has claimed that his claim for furlough has matured in accordance with the Prisons (Bombay Furlough and Parole) Rules, 1959, the Inspector General of Prisons is required to consider the same in acocrdance with the Rules and on its own merits. Accordingly, the Inspector General of Prisons is direted to decide the petitioner's applicaiton dated 27th May, 1996 within 15 days from today. Rule is accordingly made absolute.
