FAO No.4/2005

Learned counsel for the parties submit that on the asking of the Court, the parties have arrived at an out of Court settlement. They jointly pray that the impugned Award be modified to the following extent:- “Appellant Babu Ram is liable to pay a sum of Rs.1,01,000/-. The amount already stands deposited in this Court by the appellant. The claimants shall be entitled to the said amount along with interest accrued thereupon.”

The impugned Award is modified to the aforesaid extent and it is directed that instead of Rs.1,52,000/- along with interest @ 9% as originally awarded by the Tribunal, the claimants shall be entitled to a sum of Rs.1,01,000/- which was deposited in this Court plus the interest accrued thereupon. The applicants can move an appropriate application for release of the same.

The impugned Award is modified with the consent of the parties and the appeal is disposed of as such.
