Sudesh Kumari v. Pawan Singh

CMP(M) No. 1655 of 2022

Present CMP(M) No.1655 of 2022

Mr. Sanjay Jaswal, Advocate, for the applicant.

By way of instant application filed under S.5 of Limitation Act, prayer has been made on behalf of applicant for condonation of delay in filing the accompanying appeal.

Having perused averments contained in the application, which is duly supported by an affidavit and other material this court finds that delay in maintaining the accompanying appeal is neither intentional nor willful, rather owing to the circumstances, which were completely beyond the control of the appellant, as such, delay of 13 days, which otherwise stands sufficiently explained, is condoned. Application stands disposed of.
