Cr. MMO No. 32 of 2006.

27.12.2007 Present: Ms. Ruma Kaushik, Advocate, for the petitioner.

Mr. M.S. Chandel, Advocate General with Mr. P.M. Negi, Deputy Advocate General, for the respondents.

Cr.M.P. No. 586 of 2007.

As the arguments were in progress, Mr. M.S. Chandel, learned Advocate General, appearing for the respondents, after his attention was invited to judgment dated 4[th] December, 2005 passed by this Court in CWP No.553 of 2004, very fairly and frankly conceded that after quashing of Annexures P-5, P-6 and P-7 in the aforesaid CWP vide the aforesaid judgment and despite liberty having been reserved to the respondents in the aforesaid CWP, the respondents did not proceed in the matter and did not pass any order qua the petitioner in accordance with the mandate contained in the aforesaid judgment. On this ground, therefore, Mr. Chandel seeks to withdraw this application with liberty to the respondents, if so advised, to proceed in accordance with the mandate in the aforesaid judgment and thereafter to take action in accordance with law, if so advised. Prayer allowed. The application is dismissed as withdrawn.
