Himachal Pradesh High Court

CIVIL APPEAL 8925 of 2008 on 12 October 2000

CWP (T) No. 8925 of 2008.

25.11.2009.Present: Mr. Jagdish Thakur, Advocate, for the petitioner.

Mr. R.K. Sharma, Senior Addl. Advocate General, with Mr. P.K. Sharma, Addl. Avocate General and Mr. J.K. Verma, Dy. Advocate General, for the respondents.

Petitioners were engaged as Lecturers in different subjects (School cadre) as per Annexures A-1 to A-3 on contractual basis in the pay scale of Rs.1800-3200 vide office orders dated 17.4.2001, 12.10.2000 and 28[th] December, 1998, respectively. They were paid dearness allowance on the basis of Annexure A-4 dated 8[th] November, 1999. However, the same was withdrawn on the basis of Annexure A-5 dated 7[th] August, 2002. Admittedly, the petitioners were not heard before the issuance of Annexure A-5 dated 7[th] August, 2002. The petitioners have suffered civil and evil consequences. The pay of the petitioners was reduced without hearing them. Accordingly, Annexure A-5 dated 7[th] August, 2002 is quashed and set aside. However, the liberty is reserved to the respondent-State to proceed with the matter in accordance with law.

The petition stands disposed of.
