Present: Mr. Rakesh Jaswal, Advocate, for the appellant.

Mr. N. K. Thakur, Advocate, for respondent No.1.

Mr. Tara Singh Chauhan, Advocate, for respondent No.2

FAO No. 2/2005

Learned counsel for the parties jointly submit that the parties have arrived at an out of Court settlement. Mr. N. K. Thakur, Advocate, appearing on behalf of H.R.T.C. has graciously offered an additional sum of Rs.15,000/- as compensation to the claimant. This is over and above the awarded amount which also stands withdrawn by the claimant. Mr. Rakesh Jaswal, learned counsel for the appellant has accepted the offer.

Learned counsel for the parties jointly pray that the impugned Award be modified and Rs.15,000/- be substituted with Rs.30,612/-. Ordered accordingly. Learned counsel also submits that no interest shall be payable on the said amount.

Mr. Thakur submits that additional amount of Rs.15,000/- shall be deposited in this Court on or before 28[th] February, 2009.

It shall always be open for the claimant to move an appropriate application for withdrawal of the same.

With the aforesaid observations, the appeal stands disposed of as having been compromised and the impugned Award is modified accordingly.
