ORAL JUDGEMENT

Learned counsel for the petitioner submits that during the pendency of this special civil application, the very construction of the eating house has been demolished by the Roads and Buildings Department of the Government of Gujarat and this matter as it stands today has become infructuous. Order accordingly.

The special civil application is dismissed as having become infructuous. Rule discharged. Interim relief, if any, granted stands vacated. However, dismissal of this petition will not come in the way of the petitioner, if in future occasion arises to apply for registration of the eating house and if such an application is made it has to be decided on merits in accordance with law without being influenced by the fact that the earlier application has been dismissed.
