Himachal Pradesh High Court

WRIT PETITION 15946 of 2008 on 27 June 1957

CWP(T) No.15946 of 2008.

12.11.2009. Present:

Mr. Vijay Bhatia, Advocate, for the petitioner.

Mr. R.K. Sharma, Senior Addl. Advocate General with Mr. Anil Jaswal, Dy. Advocate General, for the respondents.

The petitioner was appointed as Forest Guard on 8.9.1976. He submitted his matriculation certificate whereby his date of birth was shown as 27.6.1951. This entry was incorporated in the service record. He has never pointed out any discrepancy in his date of birth. He made a representation for the correction of his date of birth after 31 years. He was called upon by the respondents to produce the original matriculation certificate in which his date of birth is shown as 27.6.1957 instead of 27.6.1951, as recorded in the service record. He has also relied upon the certificate issued by the Panchayat. The petitioner has not submitted the certificate as asked for by the respondents. Alteration in the date of birth is required to be done as per Rules within a period of two years. Consequently, there is no merit in the writ petition and the same is dismissed.
