CORAM: HONOURABLE MR.JUSTICE UMESH A. TRIVEDI

Date : 31/12/2018 ORAL ORDER

Party-in-person Jaheda Ramzanbhai Shaikh, sister of the under trial prisoner has filed this application for temporary bail for the purpose of performing after death ceremony 10[th] and 12[th] day of Salimabanu Miranmiya grandmother of the under trial prisoner, who has died on 20.12.2018. As such there is no such after death ceremony being performed in the religion which the under trial prisoner is following, there is no necessity to grant any temporary bail on this ground. Further more, from the jail remarks, it appears that vide Criminal Misc. Application No.24052 of 2018, this Court has already granted temporary bail for the very same purpose from 27.12.2018 to 29.12.2018, still, however, the under trial prisoner had reported to the jail authority on 31.12.2018 i.e. today 11:50 a.m. Hence, this application is rejected.
